January 23rd, ready to register equal marriage!!
January 23rd, 2025, was a historic day when the “Marriage Equality Law” was officially enforced. This law allowed couples of all genders to legally register their marriages and have equal rights and duties, such as managing inheritance and property and joint adoption of children.
The rights are effective immediately upon registration of marriage as required by law. The important rights and duties that “spouses” will receive are summarized as follows:
1. Engagement – Engagement can only be done when both parties are 18 years old. Engagement is considered an expression of intention to marry in the future. The engagement will be complete when the person requesting the engagement provides or transfers the engagement property to the other party as evidence that they will marry. Once engaged, the engagement property will become the right of the engagement recipient.
2. Marriage – Marriage can be done when both parties are 18 years old. However, if there is a proper reason, the court can allow the marriage to be done before the specified age.
3. Marriage Registration – Marriage is legally valid when both spouses express their consent before the registrar and the registrar officially records such consent.
4. Marriage Registration with Foreigners under Thai Law – A person who wishes to register a marriage with a foreigner can register a marriage under Thai law within Thailand. The place to register a marriage is the district office in Bangkok or abroad at the Thai embassy or Thai consulate-general abroad.
5. Divorce – When the spouses decide to separate, the divorce will be complete only when the divorce is registered according to the law. If the divorce is by mutual consent, it is written which party will exercise parental authority over which child. If there is no agreement or agreement cannot be reached, the court will decide, including making a contract on how much child support will be paid. When both parties divorce, each party’s marital property is divided equally.
6. Joint Asset Management – Joint Debts Spouses have the right and duty to manage assets acquired jointly during the marriage, including taking care of the benefits from those assets and jointly managing debts and assets between spouses.
7. Government benefits and welfare – Spouses are entitled to receive various welfare and benefits provided by the government, such as tax deductions, social security rights, retirement pensions, and other benefits as spouses.
8. Medical consent – In the event that one spouse needs to receive medical treatment, the other spouse has the right to give consent on his/her behalf, which is in accordance with the principle of consent for medical treatment. In the event that the patient is not in a condition to receive health information in order to make a decision on medical treatment, the legal heir must be notified, and the spouse is also a legal heir under the law.
9. Maintenance – Spouses have the right to claim maintenance from each other in the event of lack of a proper care, similar to the right to claim maintenance between parents and children.
10. Adoption – Spouses have the right to jointly adopt children, with the main condition being that they must receive consent from the other spouse and must comply with other criteria specified by law.
